1. The agreement
These terms are a contract between you and ReplyRush (“we”, “us”). By creating an account or using ReplyRush you accept them. If you are accepting on behalf of a business, you confirm you are authorised to bind that business, and “you” means both you and it.
Our privacy policy forms part of this agreement.
2. What ReplyRush does
ReplyRush retrieves the public reviews from listings you connect, drafts a reply to each one in a tone you configure, and — after you approve it — publishes that reply to the listing on your behalf.
ReplyRush does not publish anything you have not approved. Draft generation is automatic; publication is not.
3. Your account
- You must be at least 16 and able to enter into a contract.
- Give accurate information when you sign up, and keep your email address current — it is how we reach you.
- You are responsible for keeping your password safe and for everything done through your account. Tell us promptly if you think it has been compromised.
- You may only connect listings for businesses you own or are authorised to manage.
4. Your content and your replies
Your restaurant details, brand voice settings and approved replies remain yours. You grant us only the permission we need to operate the service: to store that content, send the parts described in our privacy policy to our providers, and publish an approved reply to the listing you told us to publish it to.
When you approve a reply, it becomes your published statement. You are responsible for its accuracy and for any commitment it makes — including any discount, refund or other offer it contains. Read before you approve.
5. Connected platforms
Google, Yelp and any other platform you connect have their own terms, and your use of ReplyRush does not exempt you from them. You are responsible for complying with their policies on responding to reviews. These platforms may change or withdraw their APIs at any time; if that stops a connection working, we will tell you, but we cannot promise a replacement.
We are not affiliated with, endorsed by, or sponsored by Google or Yelp.
6. AI-generated drafts
Drafts are produced by an AI model. They can be wrong, tonally off, or reference something the review did not say. That is why nothing publishes automatically. Treat every draft as a starting point that needs your judgement, and never approve one you have not read.
7. Acceptable use
You agree not to use ReplyRush to:
- Post replies that are false, defamatory, harassing, discriminatory or unlawful.
- Impersonate a business you do not represent, or manipulate a review platform’s ratings.
- Publish a reviewer’s private information, or retaliate against a reviewer.
- Break, overload, probe or circumvent the service, its rate limits or its access controls.
- Resell or white-label the service without our written agreement.
We may suspend or remove access for a serious or repeated breach of this section.
8. Claims about a reply you published
A reply you approve is published under your business’s name and is your statement (section 4). If a third party brings a claim against us because of a reply you approved — what it said, an offer it made, or the fact that it was published — you will cover our reasonable legal costs and any damages or settlement arising from it. The same applies to a claim arising from your breach of section 7, or from your connecting a listing you were not authorised to manage.
This does not cover a claim caused by our own negligence, or by our publishing something you never approved. If a claim is made we will tell you promptly, let you take part in defending it, and will not settle it without asking you first.
9. Availability and early access
ReplyRush is in early access. Features may change, break or be removed, and there is no uptime guarantee. We may modify or discontinue any part of the service. Where a change materially reduces what you rely on, we will give you reasonable notice at the email address on your account.
10. Fees
ReplyRush is currently free and takes no payment details. If we introduce paid plans, we will give existing account holders notice before any charge applies, and you will never be charged without first agreeing to a price.
11. Ending the agreement
You can stop using ReplyRush at any time, disconnect any listing, and ask us to delete your account by emailing privacy@replyrush.org. We may end this agreement if you breach it, or if we discontinue the service, on reasonable notice except where a breach requires immediate action.
Replies already published to a public listing stay published — they are on that platform, not ours, and must be removed there.
12. Disclaimers
To the fullest extent the law allows, ReplyRush is provided “as is”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the service will be uninterrupted or error-free, that drafts will be accurate or suitable, or that a connected platform will keep accepting replies.
13. Limits on liability
To the fullest extent the law allows, we are not liable for indirect, incidental, special or consequential damages, or for lost profits, revenue, data or goodwill, arising from your use of ReplyRush.
Our total liability for any claim relating to the service is limited to the greater of the amount you paid us in the twelve months before the claim, or one hundred US dollars. While the service is free, that means our liability is capped at one hundred US dollars.
Nothing here excludes liability that cannot lawfully be excluded, and some jurisdictions do not allow these limits — in which case they apply to the maximum extent permitted.
14. Changes to these terms
We may update these terms. If a change is material we will update the date at the top of this page and email account holders before it takes effect. Continuing to use ReplyRush after that means you accept the new terms; if you do not, stop using the service and ask us to close your account.
15. Governing law
These terms are governed by the laws of the State of North Carolina, United States, without regard to its conflict-of-law rules. If part of these terms is found unenforceable, the rest continues to apply.
ReplyRush is available internationally. Choosing this law does not limit who may use it, and it does not take away protections your own country’s law gives you that cannot be contracted out of. Where a mandatory local rule conflicts with these terms, that rule wins.
